What is Section 14 Mental Health?
In Australian legislation, Section 14 of the Mental Health and Cognitive Impairment Forensic Provisions Act 2020 (NSW) allows individual facing criminal charges in New South Wales to seek diversion from the criminal justice system if they have mental health impairment. If a court applies section 14, the defendant may avoid conviction and imprisonment if they comply with treatment orders.
What is Pre-sentence Psychology Report
A pre-sentence psychology report is a detailed mental health document prepared by a qualied psychologist to assist the judge in sentencing a convicted offender. It aims to provide a holistic picture of the offender, helping the judge make an informed decision about the most appropriate and effective sentence.
Not all criminal cases involve a PSR. The decision to order a PSR typically depends on the severity of the offense, the criminal history of the offender, and the discretion of the judge.
